The first step is to identify how you plan to fund the purchase of your new home. Call your favorite lender and get pre-approval and determine you budget. Please have a pre-approval letter or proof of funds ready. Start searching for your home online or I can set you up with a portal.
Once you have identified a few of your favorite properties, go check out the neighborhood and homes to see if any may be a good fit. Afterwards, if you haven't already toured the home, we will schedule an in-person tour. Once you are certain the home meets your needs, I will negotiate and write a contract on your behalf.
Once under contract we will perform all due diligence acts such as inspection, appraisal, research, review documents, complete the loan underwriting, and further negotiate repairs or price, if needed. Now, we are ready to close. On closing day the commission rebate will be reflected on your settlement statement.

Terms and Conditions for Buyer Agent Rebate at Closing:
1. Introduction
1.1. These terms and conditions (the "Agreement") outline the rules and regulations governing the Buyer Agent Rebate at Closing program (the "Program") offered by John Gunnels REALTOR® (the "Company"). .
2. Eligibility
2.1. The Program is open to all eligible buyers ("Buyers") who engage the services of John Gunnels REALTOR® as their exclusive buyer's agent for the purchase of real estate within the state of Texas.
3. Rebate Amount
3.1. The rebate amount shall be determined as a percentage of the real estate agent's commission earned by John Gunnels REALTOR® for the successful closing of a real estate transaction.
3.2. To comply with laws and regulations, the rebate will be calculated on net commission. Net commission can be calculated by multiplying the commission percentage with the sales price of the home and deducting $945.00, which includes $595.00 for the agent transaction fee, and a $350 client transaction fee.
3.3. The exact rebate amount will be disclosed to the Buyer and outlined in the settlement statement before closing.
3.4. Texas law does not allow for rebate amounts to be higher than earned commission therefore, no rebate will be issued if there is no cooperating broker commission offered, or if the gross commission earned is less than the $945.00 transaction fees.
4. Buyer's Responsibility
4.1. Buyers must notify their designated agent, John Gunnels REALTOR®, of their intent to participate in the Program at the initial consultation.
4.2. Buyers must comply with all relevant local, state, and federal laws and regulations concerning rebates.
4.3. Buyers must sign an Exclusive Buyer Representation Agreement with John Gunnels REALTOR®, and must not have any other active Buyer Representation Agreement with any other Agent/Brokerage.
4.4. Buyers must notify their lender of the commission rebate.
4.5. Buyers must notify the builder, at first contact, of the representation agreement with John Gunnels REALTOR®, if purchasing a new home.
4.6. Buyers must notify John Gunnels REALTOR® of any relationship with a relocation company, referring real estate agent, REALTOR®, or referral company, and if they have an active representation agreement with any other agents. Notice of these relationships must be provided before signing a representation agreement with John Gunnels REALTOR®.
5. Disbursement of Rebate
5.1. The rebate will be disbursed at the closing of the real estate transaction.
5.2. The rebate will be issued to the Buyer in the form of a credit towards their closing costs.
6. Limitations
6.1. The rebate offered under the Program may be subject to limitations or restrictions imposed by applicable laws, lender policies, or third-party agreements.
6.2. The availability and terms of the rebate may vary depending on the specific real estate transaction and circumstances.
6.3. Cannot be combined with any other offer or promotion provided by John Gunnels REALTOR®.
7. Tax Considerations
7.1. Buyers are responsible for understanding and complying with any tax implications associated with the receipt of a rebate. Consultation with a tax professional is recommended.
8. Termination or Modification
8.1. John Gunnels REALTOR® with JPAR® reserves the right to terminate, modify, or suspend the Program at any time without prior notice.
8.2. Any changes to the Program will be communicated to Buyers through the Company's official channels.
9. Promotion Deadline
9.1. Promotion commences January 03, 2024 at 12:01 am Central Standard Time (CST).
9.2.The promotion ends on January 31, 2024, at 11:59 pm Central Standard Time (CST).
9.3. All notices of intent to participate in the Program and signed Buyer Representation Agreements must be submitted before the end of the promotion to be eligible.
9.4. Buyer Representation Agreements signed before the deadline but extending past the expiration of the deadline will be honored.
10. Interaction with Other Incentives
10.1. The rebate program may or may not be able to be combined with other incentives and offers by the sellers, lenders, subsidies, grants, or other providers.
10.2. Other incentives will take priority over this offer, and limitations may be imposed by government regulations or lender's terms and conditions.
11. Governing Law
11.1. This Agreement shall be governed by and construed in accordance with all local, state, and federal laws and regulations.
12. Disclaimer
12.1. The rebate is offered solely by John Gunnels REALTOR® and not by JPAR® Real Estate.
12.2. JPAR® Real Estate assesses a $350 transaction fee for all real estate transactions other than leases and land-only transactions to all clients. The $350 fee is independent of any commission rebate or other programs, and will be assessed and due at closing.
13. In the Event of No Cooperating Broker Compensation
13.1. In situations where the Listing Broker is not offering cooperating broker compensation, or if the compensation offered is less than the negotiated compensation stipulated in the Buyer's Representation Agreement, the following terms and conditions apply:
13.2. Notification to the Client:
The Buyers will be promptly notified by John Gunnels REALTOR in writing, via email, text, or through other mutually agreed-upon communication channels, that the Listing Broker is not offering compensation or that the compensation being offered is lower than what was initially negotiated in the Buyer's Representation Agreement.
13.3. Disclosure of Compensation:
John Gunnels REALTOR will fully disclose the details of the cooperating broker's compensation or the absence thereof, ensuring transparency and clarity for the Client.
13.4. Buyer's Options:
Upon receiving notification, the Buyer will have the following options:
a. Accept the terms as presented and proceed with the transaction, acknowledging that the Buyers will be responsible for the compensation negotiated in the Buyers Representation Agreement.
b. Choose not to proceed with the transaction and seek an alternative property or property transaction where the compensation terms align with their expectations.
13.5. No Obligation to Pay:
The broker shall not be held responsible for covering any shortfall in compensation if the Listing Broker compensation offer is less than the negotiated compensation, as outlined in the original Buyer's Representation Agreement.
13.6. Buyer's Acknowledgment:
By proceeding with the transaction or entering into any renegotiation of compensation terms, the Buyers acknowledges their understanding of and agreement to these terms in the event of no cooperating broker compensation.
